|Declaration of the Antitrust Commissioner|
Tel Aviv, November 14, 2012. The Delek Group Gas Partnerships received a notice from the Antitrust Authority Commissioner declaring the Tamar partners as a monopoly in the supply of natural gas to Israel, as of the earlier of the second half of 2013 or as at the beginning of the commercial supply of gas from Tamar. It should be noted that the natural gas supply agreements between Tamar partners and gas consumers were submitted for approval of the Antirust Authority Commissioner and as of the date of this report, the Commissioner has granted the Partnerships a conditional exemption to restrictive arrangements from restrictive arrangements in most of these agreements, including an agreement with the Israel Electric Company. In addition, an exemption was granted to other agreements with additional gas consumers and the remaining agreements are pending approval as mentioned above. The partnerships are considering further steps, including filing an appeal to the Antitrust Authority.
